The Chaguaramas Development Authority (CDA) won a major judgement in the High Court yesterday, after High Court Judge Ronnie Boodoosingh turned down an application for an injunction by a member of the Guave Road Farmers Association to stop road development works in the area.
Justice Boodoosingh was of the view that the proposed claimant, Philogene St Martin, was unable to establish the boundaries of the land dispute, and did not show sufficient evidence of his loss in crops produced, sold or damaged.
Also, due to the large sums of money invested to develop the Guave Road area, the Judge determined that the CDA, acting in accordance with the Act and in the public interest, would be prejudiced if the injunction was granted.
On the issue of costs, he ruled that since it is the intention of the Claimant to file a claim for adverse possession, he placed a hold on same pending the determination of the High Court matter.
